Time Limits for Personal Injury Claims in Oklahoma

When you decide to file a personal injury claim, Oklahoma law states you typically have two years from the date of the accident to bring a personal injury suit forward. If a person has died as a result of a personal injury and a surviving family member or representative wishes to pursue a wrongful death action case, the time limit from the date of the death is also 2 years.

In OKC, personal injury claims are filed in the Oklahoma County Court, and the size of the requested compensation further determines who will oversee the trial. The first step in determining the how much will be sought in compensation is to determine the levels of responsibility.

Comparative Negligence

Personal injury cases tend to be the result of the negligence of one or more of the involved parties. Oklahoma applies comparative negligence to the state’s personal injury claims. Under comparative negligence laws, if you are less than 50% responsible for the negligence that resulted in injuries, you can pursue a claim. However, your damages will be reduced by the percentage of negligence that you are responsible for. For example, if it’s determined that you are 40% at fault for an accident that caused $1,000 in damages, you are only able to receive 60% of that or $600.
